Terms of Contract

This contract is intended to ensure that your cake will be made, designed and delivered according to your specifications.

Retainer:

Your date is reserved and your order confirmed only upon execution of this contract and when the retainer is received by The Sugared Thistle Cake Co Ltd. The retainer is generally equal to one third of the total balance for wedding cakes and £20 for celebration cakes and is required to reserve the date. The retainer is non-refundable in the event of a cancellation. However, if you need to change the date or move your event please contact me and I will attempt to make accommodating arrangements. I understand that things can come up that are completely out of your control. Payment can be made via cash, bank transfer, credit card. Cash is only accepted in person.

Final Payment:

Payment of your remaining balance, if any, is due four weeks before the cake is due for weddings and on the day when you collect your celebration cake. If payment is not received prior to the event I reserve the right to refuse your order. Absolutely no refunds shall be granted within 12 weeks of a wedding event. If, due to unforeseen circumstances, you need to rearrange your wedding date then any monies paid will be transferred to your new date.

Changes:

The date of your final payment is the final date for any changes of size, style or flavours of the cake. Any changes requested after this date cannot be guaranteed and may be subject to additional charges.

Food Allergies:

The Sugared Thistle Cake Co Ltd is not an allergy-free kitchen. I cannot guarantee that my products are free from ingredients that may affect those with food allergies but all efforts are made to minimise this risk where requested. I recommend that you contact me to discuss any food allergies you may have. The Sugared Thistle Cake Co Ltd will not assume any liability for adverse reactions to my products.

The following ingredients are used in my kitchen:

Milk and other dairy products
Eggs
Nuts: peanuts, pecans, walnuts, almonds, cashews, coconut
Wheat and gluten
Sulphites
Soya

Please note that some food colourings may have an effect on behaviour in children.

Flowers:

If flowers are provided by an outside source you acknowledge that fresh flowers are not a food product and may contain pesticides, insects, dirt, or other contaminants.

Photographs:

I reserve the right to use any photographs for my reference, display or promotional advertisement without compensation to you.

Delivery and set up:

Delivery and set up is required for all wedding cakes and for some multiple tiered special occasion cakes. There is a charge for this service and this is distance based. Should you choose to pick up your wedding cake from The Sugared Thistle Cake Co Ltd, I will not be responsible for damage incurred once the cake leaves my premises.

Release of Liability:

The Sugared Thistle Cake Co Ltd will make every possible effort to create and safely deliver your cake. Once delivery and set up is complete The Sugared Thistle Cake Co Ltd shall not assume any responsibility for your guests, florists or any other person's acts with regard to your cake. The Sugared Thistle Cake Co Ltd shall have no responsibility for the condition of the cake once delivered to you or your wedding venue. High temperatures can adversely affect your cake. It is your responsibility to arrange with the venue an appropriate spot for the cake, out of direct sunlight and away from unnecessary heat.

Privacy:

I take your privacy very seriously and will only use your personal information to administer your account and to provide the products and services you have requested from me.

Rentals:

Additional items, such as cake stands, must be returned within 48 hours of the event, unless agreed by The Sugared Thistle Cake Co Ltd. There is a hire charge for stands of £15 and a refundable deposit charge £85. The deposit is refundable provided the rental item(s) is (are) returned in the same condition within 48 hours of the delivery time and date, unless otherwise agreed. After 48 hours, the deposit is forfeited.

Guarantee:

Cake design is a creative and organic process. I will endeavour to replicate and create your selected design as closely as possible. I promise to do everything in my power to deliver a cake that exceeds your expectations and will work with you on every level to make sure you are completely satisfied with your cake.

Disclaimer:

In the case of an emergency or an error in your cake delivery please contact me immediately so I can fix the issue right away! If you are unhappy with your cake, for any reason, please call me on 07867808393 on the day of your event and explain the situation. In the rare case that you are unhappy with your cake and would like a refund, you must call the day of the event so your cake can be returned. Without proof that you are indeed unhappy with the product and will not be using it for your event, I will be unable to refund any portion of your payment.
